*The NSW Government would like to advise that the Real Estate Agents Prequalification Scheme – SCM4271 (the Scheme) will not be renewed after it expires at 12pm on 15 August 2020. We will not be processing any more submissions.*

Property NSW’s Real Estate Sales Agent Prequalification Scheme offers a platform for real property professionals to tender for provision of real estate services to government agencies.

The pool of prequalified real estate sales agents will provide real estate expertise and services to assist with the delivery of property disposals for a range of residential, commercial, and other assets of varied complexities across New South Wales.

To achieve prequalification, Applicants are required to provide evidence of successful property sales (transacted within the past 12 months for the small and medium sale categories or 24 months for the large, major, and complexity sale categories) within the category/ies nominated, and 2 referee reports confirming organisational capability in that type of work.

Note: We are seeking local agents. Each office of a franchised agency that wishes to participate in the Scheme is required to complete an Application for the Region in which they are based. Applicant must provide their unique ABN, and not that of their head office. The requirement also applies to offices that operate under one corporate licence. Head offices can submit a corporate application, provided it is in addition to the local office submissions.

Scheme Conditions, Agency Agreements and Special Conditions (Annexure to Agency Agreements) shall be agreed in principle upon submission of your Scheme Application.

Project specific terms such as scope, timeline and fees shall be agreed during subsequent tender processes.

Vendor Instruction

Applicants must answer all questions in this online application and provide the information requested.

Incomplete applications or applications deemed unsatisfactory may be rejected by the Scheme Administrator.

It is recommended that applications are submitted from a generic/proxy email address (such as tenders@###.com) to ensure that no applications are lost because of staff absences. Correspondence about the application for prequalification will be sent to the email address that submitted the application.

Please note that franchise agencies and offices that operate under one corporate licence are required to complete a separate application for each office that wishes to participate in the scheme. The Head Office may also choose to submit a separate corporate application in addition to the local submissions; as they may be approached for larger scale procurements.

Applicants must identify their area of expertise by nominating their preferred Region/s and Value categories for one or both Property Types.

It is recommended that the applicant download and review the scheme documents prior to completing the application. Refer in particular to the “Template 2 – Experience and Capabilities” document which will provide guidance for capability selection.

Real Estate Sales Agent

You will be asked to select region/s and value category/ies within one or both property types (Residential / Other: Commercial/Retail/Industrial/Vacant Land) for which you can provide sufficient evidence of your experience. You will also have the opportunity to select one or more specialised areas of expertise (Complexities), should that apply to your business. (Refer to the "Guidelines for Applicants" document for a definition of the property types.)

    Property NSW, the manager of the Real Estate Sales Agent Scheme (Scheme Number SCM4271), undertook a review of the Special Conditions for the REINSW Sales Inspection Report and Exclusive Agency Agreement.

    The new agreement will apply to all suppliers under the Scheme and, as a prequalified supplier under the scheme, PNSW is providing you notice of the new Special Conditions to the ‘Sales Inspection Report and Exclusive Agency Agreement’ (New Terms). It will apply to all engagements under the Scheme. If you do not agree to the New Terms, please advise so that your firm can be removed from the Scheme.

    You should read the New Terms but in brief, the changes are to the following clauses: Indemnity, Material Fact Disclosure, Privacy, Promotional Activities and Insurance. There are also new clauses regarding performance, warranties, compliance with Anti Money Laundering and Counter Terrorism, Financing Act requirements. There is also a change to clause 3 on remuneration: it deletes the Principal’s liability for payment after the exclusive agency period.

    Summary:

    • The Principal can terminate or vary the exclusive agency period with 30 days’ notice
    • Remuneration is not payable for a sale if the contract is entered more than 30 days after expiration of the exclusive agency period
    • Remuneration calculated exclusive of any GST
    • New clause requires all promotional activities be undertaken with the principal’s approval
    • Clarification to confirm that the remuneration is payable at the completion of the sale
    • The indemnity and liability clause is clarified
    • The material fact clause confirms the obligations of the Principal to disclose all material facts in its possession to the Agent
    • The privacy clause sets out the obligations of the Agent in the collection, use and storage of personal information obtained in the course of performing this Agreement to ensure that the Agent acts in line with the statutory obligations
    • A new clause confirms that the Agent is to Perform Services with care and expertise expected, and in accordance with all applicable laws
    • A new clause provides Agent warranties for the provision of services pursuant to this agreement
    • There is a new clause requiring the Agent to act in compliance with Anti-Money Laundering and Counter-Terrorism Financing Act 2006
    • The Insurance requirements for the Agent are specified.
