The Prequalification Scheme (the Scheme) for Statutory Appointments under legislation administered by the Minister for Innovation and Better Regulation is focused on achieving a competitive and experienced panel of providers to provide the services required.

The Scheme offers a streamlined process for making, managing and concluding statutory appointments. This gives NSW Fair Trading a competitive pool of prequalified service providers to undertake the statutory appointment function.

The Scheme covers the following categories under relevant legislation:

  • Accounts Examiner

  • Manager

  • Receiver

Initially the Scheme will seek prequalification of Service Providers for appointments under the Property Stock and Business Agents Act 2002 (PSBA Act) and the Conveyancers Licensing Act 2003 (CL Act).

The scheme sets out the process for applying for, and prequalifying for, statutory appointments, pursuant to legislation administered by NSW Fair Trading. The scheme will initially seek prequalification of Service Providers for appointments as an Account Examiner, Manager, and/or Receiver under the Property Stock and Business Agents Act 2002 and Manager, and/or Receiver under the Conveyancers Licensing Act 2003.

The Prequalification Scheme: Contingent Workforce is a new operating model for government. This model is transforming the mechanism by which contingent labour is sourced, managed and reported on within NSW Government; with a complement of four sub-category projects:

1. Vendor Management System (VMS) - Single vendor neutral recruitment technology provider

2. Managed Service Provider (MSP) - Panel of neutral providers

3. Payroll processing - Panel of dedicated providers of payroll functions 

4. Prequalification scheme of recruitment suppliers

5. This prequalification scheme replaced Contingent Workforce Contract 100 and is used to access the market for contingent labour. This Scheme is managed by NSW Procurement and leverages government buying power whilst opening up opportunities to small and medium enterprises, regional and boutique suppliers.

The objective of this Scheme is to provide a quality contingent workforce that is effectively and efficiently controlled and co-ordinated across government. This Scheme will see the implementation of systems and processes to manage appropriate buying behaviour aligned to Government Workforce Planning objectives and will capture information associated with NSW Government’s use of contingent workforce to reduce cost and improve candidate quality.

 

This Scheme will evolve to continue to meet the needs of all stakeholders and brings the following benefits to NSW Government and suppliers:

1. Opening up of categories – allowing suppliers to nominate the categories they have demonstrated their capability and providing hiring managers with more choice of suppliers

2. Supplier mark-up has been standardised allowing hiring managers to focus on candidate quality instead of cost

3. Temp to Perm conversion fee is a sliding scale over the initial 12 month period

4. Simplifying procurement practice and

5. Removes unnecessary red tape which negatively impacts on buyers and suppliers.

The NSW Government has taken the decision to convert a number of closed panel contracts to pre-qualification schemes while being respectful of associated risk and preservation of its market leverage.

This Scheme also aims to reduce off contract spend and improve compliance by allowing all suppliers who meet the scheme conditions to do business with government agencies.

The Scheme will continue to utilise categories for ease of searching and reporting. Over the life of the Scheme there will the flexibility to add more specialised role types as and when required. Prequalified suppliers will be able to apply for any and/or all categories and will be able to update their areas of capability in a simple manner.

The NSW Government ICT Services Scheme is the new model for delivering ICT services to NSW Government. These new arrangements will ensure NSW government agencies can find and procure the goods and services that best meet their needs, and makes it easier for industry to do business with government.

The Scheme arose from extensive consultation about how government and industry can make the most of procurement opportunities.

The Scheme features include:

  • a new straightforward online application for suppliers removes lengthy and expensive tender processes.
  • an “always open” policy, so new suppliers can register for inclusion on the Scheme at any time, giving agencies continual access to new suppliers and emerging technologies.
  • streamlined ICT service categories aligned to the ICT Strategy, enabling suppliers to align their offerings and maximise opportunities to provide services to government.
  • introduction of two supplier lists: The Registered Supplier List for low risk contracts valued up to $150,000; and the Advanced Registered Supplier List for high risk contracts or contracts valued over $150,000.  Suppliers can apply for inclusion on one or both of these lists, depending on their capacity and capability.
  • a new, simple short-form contract for the low risk low value category of work provides opportunities for small to medium businesses. It includes simplified terms and lower insurance requirements, reducing the cost of doing business with government.

In 2012 the Public Service Commission (PSC), in conjunction with the Office of Finance and Services (OFS), established the Prequalification Scheme: Executive Search (The Scheme).

A general review of The Scheme, to reflect the NSW Public Sector Executive reform, took place in November 2013. In February 2014 The Scheme was put online and was renumbered from Contract 4004 to SCM0227. This Scheme is managed by NSW Procurement and will leverage government buying power while providing opportunities to small and medium enterprises.

The Government Sector Employment Act 2013 (GSE Act) commenced on 24 February 2014 and repeals the Public Sector Employment and Management Act 2002 (PSEM Act). The GSE Act enhances the application of the principle of merit as all employment decisions are to be based on a holistic assessment of an applicant’s capabilities against the requirements of the role. The Scheme creates a framework for the prequalification of individuals and firms who provide executive search recruitment services to NSW Government Agencies and statutory corporations.

This Scheme will evolve to continue to meet the needs of all stakeholders and brings a range of specific benefits, for both Agencies and Service Providers, including:

·         Making it easier for all Service Providers to do business with NSW Government Agencies including improved access for Small to Medium Enterprises (SMEs);

·         The ability to join The Scheme at any time;

·         A new self-service, online application process;

·         Allowing Service Providers to nominate their area of industry expertise;

·         Tier One for providers of  executive search services for Department Secretaries and the most senior roles within Senior Executive Band 3 (for example Deputy Secretaries of large portfolios and Agency Heads);

·         Tier Two for providers of executive search services for Senior Executive Bands 1, 2 and 3;

·         Providing hiring managers with more choice of Service Providers;

·         Streamlined competitive tendering processes by accessing prequalified Service Providers with a demonstrated track record;

·         Enhanced probity standards through third-party assessment and selection of Service Providers;

·         Standardised Service Provider mark-ups allowing hiring managers to focus on candidate quality instead of cost;

·         A significant reduction in red tape and cost in doing business with government;

·         The removal of the management fee;

·         Providing opportunities to SMEs;

·         Encouraging SMEs to apply by removing barriers to regional applications;

·         Simplifying procurement practices; and

·         A self-service, online application process.

 

To assist Service Providers and Agencies with their sourcing activities The Scheme is now available online and brings a range of specific benefits as follows:

·         Service Providers will be able to complete the online application form, indicate their area of industry expertise, upload the required documentation/certification and pre-agree The Scheme Conditions;

·         Agencies will be able use the eQuote system to undertake online quoting activities using prequalified Service Providers and standard agreement arrangements;

·         Through the eQuote system prequalified Service Providers may receive a request for services from Agencies;

·         Service Providers will be able to view requests, send their intention to respond, respond to a request, ask questions, withdraw a response or decline an invitation online;  

·         Agencies will be able to evaluate the responses they receive and the selected Service Provider will then only need to agree the a formal scope of works and price with an Agency.

In 2012, the New South Wales Treasury (Treasury') established a prequalification scheme of lead Advisers to advise the Government in relation to any corporate advisory projects, commercial asset sale transactions and public private partnership projects for a 3 year period (the Scheme’).

In February 2015, the Scheme was extended for another 3 years through a re-launched EOI (with an option for two one year extensions should the Government deem the need for a continuation of the Scheme i.e. 3+1+1).

Treasury is seeking expressions of interest (‘EOI) from suitable organisations for the new prequalification Scheme to advise the Government over a further extended 3year period (with an option for two one year extensions should the Government deem the need for a continuation of the Scheme i.e. 3+1+1).

NOTE: This reissue of The Expression of Interest for the existing Prequalification Scheme is for NEW PROPONENTS ONLY.

PART A: Corporate and Transactions Advisory, Financial Adviser;

PART B: Corporate and Transactions Advisory, Accounting and Tax Adviser;

PART C: Public Private Partnership, Financial Adviser; and

PART D: Public Private Partnership, Specialist Industry Adviser

Interested Parties may submit proposals for one or more of the above Scheme appointments. The Corporate and Transactions Advisory and PPP Financial and Specialist Industry Advisory Scheme will be made up of selected proponents ('Selected Proponents') who are qualified to provide financial, accounting and tax advice, PPP financial and PPP specialist industry advice in relation to corporate advisory projects, commercial asset sale transactions and PPP projects.

The Scheme will comprise of shortlisted Respondents who are suitably qualified to provide advice and project leadership for Commercial Projects, State Asset Divestment Projects, PPP projects, and expert advice on specific projects that are not typical PPP projects.

 The National Public Private Partnership Guidelines 2008 governs the procurement of Public Private Partnerships(‘PPP’),with NSW requirements detailed in NSW Public Private Partnership Guidelines (2012).

To assist in the evaluation and development of projects under these Guidelines, Treasury maintains two categories in the PPP pre-qualified scheme:

1. a  category  of  pre-qualified  financial  advisers  to  assist  the  Government  with  PPP projects; and

2.  a category of pre-qualified specialist industry advisers to assist the Government with projects
