The Contract for which a Tender in accordance with these conditions is to be made shall be on a Schedule of Rates basis. The initial Tendered rate(s) will be fixed for the first three month period of the Contract, thereafter rates will be revised in three month intervals based on the rise and fall clause stated in clause 3.26.

 

The scope of Contract Works covers the Supply and Delivery of:

 

·         Bituminous Cold Mix

 

to various locations through-out the Wyong Shire local government area, as and when required and over a period of up to 36 months commencing from the date of acceptance of tender.

The Principal uses approximately 800 tonnes of bituminous cold mix per annum.  This amount can vary significantly according to work programmes and weather and is advised purely as a guide only. The Principal neither warrants or guarantees the actual quantity of bituminous cold mix required from any single or all approved Contractors.

The Principal reserves the right to award Contracts to one or more Tenderer’s and to obtain the specified materials from one or more sources of supply. Subject to tenders received, the Principal is intending to rank tenders in order of price, quality, availability and conformance. Purchase Orders for supply of specified materials will be issued to Contractors in order of rank.

Upon request, the Tenderer shall submit satisfactory evidence that they have been engaged regularly in the class of work required and that they possess the necessary skills, expertise, financial capacity, material and machinery to fully carry out the works in a professional manner and to the satisfaction of the Principal.
