The Contract Value will not be disclosed on the contract register for the following reasons:
• The contract value is commercial in confidence; and
• There is an overriding public interest against disclosure of the contract value because the contractor is a sole trader and the information could reasonably be expected to:
• undermine the competitive neutrality in connection with the functions of Destination NSW by making public the rates that are paid to the contractor; and
• diminish the competitive commercial value offered to Destination NSW on the one hand (by making public the rates it has agreed to pay the contractor) and to the contractor on the other hand (by making public the rates it has agreed to accept) in payment for services; and
• prejudice the contractor’s legitimate business, commercial, professional and financial interests by disclosing the value of the rates that it has agreed to accept for services offered to Destination NSW.
• In addition, there is an overriding public interest against disclosure of this information in accordance with section 32 of the GIPA Act. |
